Privacy Notice

We respect your privacy. The Oklahoma Department of Commerce welcomes visitors to its website and is grateful to subscribers of our various e-mail notices and newsletters. While we collect various information about visitors and their website and e-mail activity, we do not share that information with anyone outside the agency, and we carefully protect the information to prevent anyone else from accessing it illegally.

Website Data Collection

We use a tool called “Google Analytics” to collect information about the use of this site. Google Analytics collects information such as how often users visit this site, what pages they visit when they do so, and what other sites they used prior to coming to this site. We use the information we get from Google Analytics only to improve this site. Google Analytics collects only the IP address assigned to you on the day you visit this site, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with personally identifiable information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit this site, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to this site is restricted by the Google Analytics Terms of Use (as amended for government websites) and the Google Privacy Policy. You can prevent Google Analytics from recognizing you on return visits to this site by disabling cookies on your browser.

All of this data is used in aggregate to help us continually improve the website and deliver content and functionality that visitors will find useful.

We also have forms on the site and forms services that collect visitor information. These forms include newsletter and email subscription forms; lead generation forms; event registration forms; registration forms to access premium content; and program applications. Information provided on these forms is for internal use only and not shared with anyone outside the Oklahoma Department of Commerce, with two exceptions. For events that Commerce co-sponsors with another organization, we might share the registration information with event coordinators from the co-sponsoring agency so they may communicate event details to registrants. For program applications we might share application information with partners, including other state agencies, for data validation, scoring and other program-specific needs and requirements.

Email Marketing Data Collection

When Commerce sends email newsletters, event invitations and reminders, and similar announcements through our email marketing system, we can tell if the recipient opened the e-mail and whether the recipient clicked a link in the e-mail. Further, we can tell if the recipient forwarded the e-mail, though we cannot tell who the forwarded e-mail was sent to.

Our distribution lists are compiled through online subscription forms on the Commerce website, through personal requests for inclusion on certain mailing lists, and through contacts made with Commerce staff.

Each email newsletter/alert includes an unsubscribe link near the bottom of the page. Email recipients may also contact us at info@okcommerce.gov or 800-879-6552 to be removed from a mailing list.

At no time will Commerce send commercial email.

We do not sell or otherwise share our distribution lists or information collected through our website or e-mail marketing system with outside parties. However as an Agency of the State of Oklahoma, we are governed by the Oklahoma Open Records Act, and your e-mail address may be subject to disclosure.

Sharing and Storage of Personally Identifiable Data

The Oklahoma Department of Commerce may collect personally identifiable data during the course of exercising its statutorily mandated duties, as supplied by employees, applicants, permittees, licensees, vendors, or other individuals doing business with or interacting with the agency. This personally identifiable data includes information which can identify an individual including, but not limited to: name, birth date, place of birth, mother’s maiden name, biometric records, Social Security number, official state- or government-issued driver license or identification number, alien registration number, government passport number, employer or taxpayer identification number, or any other information that is linked to linkable to an individual, such as medical, educational, financial, or employment information. 74 O.S., § 3106.4. Personally identifiable data is stored securely in accordance with Oklahoma law, as well as the State of Oklahoma’s Information Security Policies, Procedures, and Guidelines, available at at Policy, Standards & Publications (oklahoma.gov).

This data is almost exclusively stored electronically on servers maintained by the Office of Management and Enterprise Services, with very limited amounts of this data maintained in a hard copy by program managers to whom this information is submitted. Personally identifiable data collected by the Department of Commerce shall be kept confidential except as disclosure may be required pursuant to the Open Records Act or as otherwise authorized by the person to whom the personally identifiable data belongs.  The Oklahoma Department of Commerce is subject to and complies with the Oklahoma Open Records Act, 51 O.S., §§ 24A.1 – 24A.33. In accordance with said law, some agency records must be made available for review and copying upon request. Where required or allowed by law, particular elements of personally identifiable data will be redacted before making the records available. The Oklahoma Department of Commerce will also share personally identifiable data in response to a properly issued court order or subpoena.
